INTELLECTUAL PROPERTY

Ownership of Intellectual Property: The Company retains all rights, title, and interest in and to all intellectual property related to the Products, including but not limited to their design, labeling, packaging, and the brand mascot. These rights are either owned by the Company or licensed from third parties.

Prohibited Actions: You must not copy, reproduce, manufacture, distribute, modify, create derivative works from, or otherwise commercialize the Products or any part of the intellectual property without the Company's prior written consent.

Scope of Intellectual Property Rights: For the purposes of this clause, “intellectual property rights” encompass all current and future worldwide rights under patent law, copyright law, trade secret law, trademark law, moral rights law, and any and all other proprietary rights. This includes, without limitation, all rights to and applications for:

  1. Trademarks and Trade Dress: All trademarks, service marks, trade names, logos, and other source identifiers, including those currently under evaluation and pending finalization.
  2. Copyrights: All original works of authorship, including literary, graphic, and audiovisual works, encompassing the brand mascot and product designs.
  3. Designs: All design rights, including those pertaining to the appearance and aesthetics of the Products and their packaging.
  4. Patents: All patents and patent applications, including all related continuations, continuations-in-part, divisions, reissues, and reexaminations.
  5. Trade Secrets: All trade secrets and confidential business information, including know-how, formulas, compositions, processes, techniques, and business methods.
  6. Domain Names and Digital Rights: All internet domain names, social media handles, and other digital properties.

Legal Enforcement: The Company reserves the right to enforce its intellectual property rights to the fullest extent of the law, including seeking damages, injunctions, and attorney's fees.

Global Protection: This intellectual property policy applies worldwide, ensuring that the Company's rights are protected in all jurisdictions, both now and in the future.
